Changes Made to SAMAHQUAM Custom Election Act (Second Version Appendix H)

Changes made to the final draft have been done with input from members through four (4) zoom sessions held on April 8, 9, 20 and 21, 2021.

Summary of Changes Made

1.

Change all references of him, himself, her, and herself to them, their and themselves.

2.

Change that a Candidates' attendance at an All-Candidates meeting is mandatory.

3.

Addition of Article 3.1.1. 

The requirement that a member of SAMAHQUAM
must be a member for at least twelve (12) months prior
to nomination. 
This was added because Article 3.1.3.
originally would have covered this requirement.

4.

Remove Article 3.1.3.

"Must have served one full term in a Chief or Council position."

This was removed after discussion with members stated that they feel that this article was a barrier to members who may have equivalent experience.

5.

Article 3.1.6.

Changed the number of years to ten (10) years.

6.

Article 3.1.7.

Changed the number of years to twenty (20).

7.

Article 3.1.8.

Changed from "more than" to "within" ten (10) years.

This change was done to line up with the federal process
for pardons. Currently, the time limit to apply for a pardon
within Canada is after ten (10) years from the date of when probation has ended.

8.

Article 3.2.2.

Minimum age to hold the position of Councilor changed to twenty (20) years of age.

Article 3.2.5

Changed the number of years to ten (10) years.

10.

Article 3.2.6.

Changed the number of years to twenty (20) years.

11.

Article 3.2.7.

Changed from "more than" to "within" ten (10) years.

This change was done to line up with the federal process for pardons. Currently, the time limit to apply for a pardon in Canada is after ten (10) years from the date of when probation has ended.

12.

Addition of wording to Article 5.3.7. to support Article 6.6.

13.

Addition of Article 5.4 — Administrative Leave

This article was added to provide an avenue, should an individual sitting as Chief or Council be charged with a crime, to be placed on Administrative leave while an investigation is underway. Should this individual be convicted, Article 5.3. already covers how to suspend this individual from their elected seat. Should the investigation end with no conviction, then the individual may return to their duties.

Article 6.4.

Changed the length of time for suspension from six (6) weeks to twelve (12) weeks.

15.

Article 26.1.

Change term of office from five (5) years to four (4) years.
